Welcome to BodySong Wellness Studio.
Before booking or attending any class, workshop, or private session, please read these Terms and Conditions carefully. They explain how our classes operate, your responsibilities as a participant, and how we protect your safety and privacy.

By ticking the agreement box during booking (or by signing the enrolment form for private clients), you confirm that you have read, understood, and agree to these Terms and Conditions. This agreement forms the legal basis for your participation in BodySong Wellness Studio activities.

1. Agreement

By booking and paying for a class, course, or private session through our website, or by attending your first class, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and BodySong Wellness Studio.

When booking online, you acknowledge that classes or services may begin within 14 days of purchase. By proceeding with your booking, you consent to the service starting within this period and agree that your statutory right to cancel under the Consumer Contracts Regulations 2013 will be waived once the service has been provided in part or in full.

This does not affect your statutory rights where we are unable to provide the service as agreed.

These terms are designed to ensure a safe, professional, and enjoyable experience for all participants.

2. Health and Participation

We are not medical professionals and cannot advise whether you should join classes. If you have any doubts about your health or ability to participate, consult your doctor before joining. You must inform us of any relevant medical conditions before attending.

Participation in exercise carries an inherent risk of injury. By joining our face-to-face, live online, or pre-recorded classes, you confirm that you participate voluntarily and at your own risk. You are responsible for monitoring your own condition during exercise, stopping immediately if you feel pain, dizziness, or discomfort.

Please ensure you have a clear, well-lit, obstacle-free space for exercise and wear suitable clothing that allows free movement. Whilst we aim to provide feedback and corrections, online and pre-recorded classes cannot replicate in-person, hands-on guidance.

3. Suitable Attire

Please wear fitted, comfortable clothing that allows movement, and socks at all times. We reserve the right to ask anyone wearing unsuitable attire to leave the class.

4. Payments, Cancellations, and Refunds

All bookings made through our website are final. Please check details carefully before purchasing. Your booking is confirmed once payment has been received.

All course blocks, classes, and private sessions are non-refundable, non-transferable, and non-changeable, except where required by law. This includes situations where we have to cancel a class, in which case you will be entitled to a rescheduled session or full refund. These terms do not affect your statutory rights.

If you pay by bank transfer (e.g. for private sessions), your place is confirmed once payment is received and acknowledged.

5. Class Schedule and Attendance

Classes are typically 60 minutes unless otherwise stated. Timetables and locations are listed on our website and may change; we will give as much notice as possible.

Please arrive on time. Classes cannot be extended or refunded if you arrive late. You may not transfer your place to another person. If you leave a course partway through, you forfeit any unused sessions.

All clients must complete a health and enrolment form before attending their first session and update it annually.

6. Courtesy Class Swap System

You may cancel a class up to 4 weeks in advance and no later than 2 hours before class to receive a class credit. Cancellations made later than 2 hours before start time will be forfeited.

Class swaps are subject to availability via our Gymcatch booking system and cannot be guaranteed. Credits must be used within the same course and cannot be carried forward. Credits are not redeemable for cash or transferable to another person.

7. Pay-As-You-Go (PAYG) Holiday Classes

PAYG bookings may be cancelled up to 24 hours before class without charge. Cancellations made less than 24 hours before start time or “no-shows” will be charged in full. Repeat no-shows may lose booking privileges. No refunds are given for missed classes.

8. Private Pilates Appointments

Appointments are non-transferable. You may cancel up to 24 hours before the session without charge. Cancellations made within 24 hours will be charged in full.

All blocks of private sessions must be used within six months (180 days) of purchase. Unused sessions will expire after this time.

If we need to cancel a private session, we will offer an alternative appointment or a full refund.

9. Equipment and What to Bring

We can supply small equipment for use during classes, though clients are encouraged to bring their own mats for hygiene reasons. Please wear clean socks and bring a water bottle.

During heightened hygiene periods (e.g. COVID-19), clients must bring their own mat, softball, theraband, yoga strap, and block. Contact us for advice on where to buy these items.

10. Noise Levels

Please respect the tranquil environment of BodySong Wellness Studio and other businesses at Layby Farm by keeping noise to a minimum when arriving and leaving.

11. Lost Property

Belongings are brought to the studio at your own risk. We cannot accept liability for loss, damage, or theft of personal belongings. If you believe you have left something behind, contact julie@bodysongwellness.co.uk or 07941 428190.

12. Data Protection

We process personal data in accordance with the UK GDPR and Data Protection Act 2018. Please refer to our Privacy Notice on our website for details of how we use and protect your data.

13. Intellectual Property

We own or are licensed to use all materials and content provided during classes, workshops, and online sessions. You may not copy, share, or reproduce any material without our prior written consent.

We grant you a limited, non-exclusive, non-transferable licence to use such materials for your personal participation only.

Recording, photographing, or sharing class content without permission is strictly prohibited.

Nothing in this clause prevents you from making reasonable personal notes or using materials privately for your own learning and practice.

14. Independent Instructors

Some yoga and wellness sessions at BodySong Wellness Studio are run by independent instructors who are fully qualified and insured. These instructors are responsible for their own classes and clients. BodySong Wellness Studio acts only as a venue provider and is not liable for any incidents arising from independently run classes.

Independent instructors operating at BodySong Wellness Studio are required to maintain their own professional insurance and qualifications.

15. Liability and Risk Acknowledgement

You understand that exercise carries risk. You agree to participate with full awareness of the risks of injury or property loss and accept responsibility for exercising within your own limits.

All instructors are qualified and insured. You agree to follow safety instructions and to notify instructors of any changes in your health. If you become pregnant or experience any medical changes, you must inform your instructor immediately.

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, or for any matter which cannot legally be excluded under English law.

Our total liability for any claim arising from services provided is limited to the total price paid by you for the classes in the 12 months preceding the claim. We are not liable for any indirect, consequential, or economic losses.

If performance is delayed or prevented by circumstances beyond our control, we will not be liable for resulting losses. This includes, but is not limited to, extreme weather, transport disruption, government restrictions, or pandemics.

16. Instructor Changes and Class Cancellations

If your regular instructor is unavailable, a qualified substitute may teach your class. Refunds will not be issued due to instructor changes.

If we cancel a class or course, you may choose either a rescheduled session or a full refund.

If a class does not have sufficient bookings to run, we reserve the right to cancel and issue a full refund.

If circumstances beyond our control (e.g. extreme weather, government restrictions, or transport disruption) prevent us from providing a class, we will offer an alternative date or online session where possible.

17. Complaints

If you have any concerns or complaints about our services, please contact julie@bodysongwellness.co.uk. We will acknowledge and respond within 10 working days.

We aim to resolve all complaints promptly and fairly.

18. Governing Law

These Terms and Conditions and any related dispute shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any claim arising from or related to this agreement.

19. Acceptance
