AGREEMENT
1. By purchasing an On Demand subscription with Bodyworks Pilates, you agree to be bound by these Terms and Conditions. Every time you visit this website, use its services or make a purchase, you accept the following conditions.
PRIVACY POLICY
2. Before you start using Bodyworks Pilates – Pilates On Demand we advise that you read our privacy policy. It will help you better understand how your information is processed and stored when you are accessing this website and our services.
LIABILITY STATEMENT
3. We are not medical professionals and cannot advise on whether you should join Pilates On Demand or not. If you have any concerns at all about your health and undertaking the classes, you should consult your doctor or other medical professional.
By choosing to access online classes with Bodyworks Pilates, you understand that when participating in any exercise or exercise program, there is the possibility of physical injury. If you engage in our pre-recorded classes, you agree that you do so at your own risk, are voluntarily participating in these activities and assume all risk of injury to yourself. You should always exercise common sense and seek the guidance of a medical professional before undertaking any form of online exercise and physical activity. If you have any pre-existing medical conditions or injuries that may affect your ability to complete on demand classes, you should seek medical advice and obtain confirmation that is safe for you take part before doing so.
Stop exercising and consult your physician if you feel dizzy, faint, light-headed or if you experience any discomfort.
4. Make sure you exercise in a large well-lit area that is free from obstacles and that you wear comfortable clothing that doesn’t inhibit movement.

5. Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.
SITE USAGE AND INTELLECTUAL PROPERTY RIGHTS
6. You may use the Site for personal and lawful use and in accordance with these terms and you may not copy or use any material from the site for any commercial purpose.
The intellectual property rights in all contents of the site and supplied as part of the Products or Services, and in the Bodyworks Pilates brands and logos (“Materials”) are owned by Bodyworks Pilates. Except to the extent expressly set out in these terms and conditions, you are not allowed to make any copies of any part of any Materials, or remove or change anything on the site, include or create links to or from the site without our written authority, or remove or change any copyright, trade mark or other intellectual property right notices contained in any Materials or copies thereof.
USER ACCOUNT
7. If you are an owner of an account on this website, you are solely responsible for maintaining the confidentiality of your private user details (username and password). You are responsible for all activities that occur under your account or password.
8. We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.
9. No children are permitted to use our site. Our services are not directed toward children under 13 years of age, nor do we knowingly collect information about children under 13. If you are under 13 years of age, you are not permitted to submit any personally identifiable information to us. If we find out you are under the age of 13 years of age, we will immediately upon notice cancel your account. 10. You agree that you will not share your account information, username and password with others. Excessive usage of the Site will be assumed by Bodyworks Pilates to be fraudulent use and your account will be immediately cancelled without a refund.
11. Only one free trial of any length is permitted per person. Bodyworks Pilates will terminate without refund any account or user that attempts to use more than one free promotional period. You may not re-active your account and use a promotional coupon to gain a second free trial.
SUBSCRIPTION TO PILATES ON DEMAND
12. Billing for Membership to Pilates On Demand.
Memberships, which provide you with access to Classes, are billed on a periodic basis as specified at the time of purchase (e.g., monthly, quarterly, or yearly). Your Membership subscription will continue in effect on a recurring basis corresponding to the term of your subscription unless and until you cancel your subscription or the account or the Service is otherwise suspended or discontinued pursuant to this Agreement. If membership is cancelled or terminated before the end of the applicable billing cycle, Bodyworks Pilates will not reimburse the Member for the remainder of that paid month. Members may cancel their membership at any time. Membership must be cancelled prior to the renewal date in order to avoid additional membership charges.
13. Pricing for Membership Subscriptions.
When you purchase a membership subscription, you will initially be charged at the rate applicable at the time of your agreement to subscribe. If Bodyworks Pilates later increases the price of the subscription, Bodyworks Pilates will notify you via email. The increase will apply to the next payment due from you after the notice, provided that you have been given at least 10 days’ prior notice before the charge is made. If you are given less than 10 days’ prior notice, the price increase will not apply until the payment after the next payment due.
SUSPENSION AND TERMINATION OF SERVICE
14. Bodyworks Pilates may suspend the operation of the site for repair or maintenance work or in order to update or upgrade the contents or functionality of the site from time to time.
15. Bodyworks Pilates may terminate your access to the Service immediately in the event you breach any of these terms and conditions or do not pay any sums due to Bodyworks Pilates (including if the credit/debit card you use is not valid or does not work for another reason).
GENERAL
16. Bodyworks Pilates may change these terms and conditions from time to time. By browsing the site, you are accepting that you are bound by the current terms and conditions. You should check these each time you revisit the site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter.
These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.
